Terms and Conditions

1              Use and acceptance

1.1          This website (Website) is owned and operated by Taco Medic International Limited (NZBN 9429047522268)) (Taco Medic). These terms and conditions and the policies referenced in these terms and conditions (together the Terms), collectively govern your use of, and access to, this Website, the TacoMedic loyalty application “TacoMedic Mates” (Loyalty App) and the “TacoMedic” application (Ordering App) (together, the Apps).

1.2          By accessing or using any part of this Website or the Apps, you agree to be bound by these Terms.

2              Changes to these Terms

2.1          We may make changes to the Terms at any time with or without notice to you. Any amendment will be effective immediately upon being posted on the Website. Your continued use of the Website and/or the Apps constitutes your unconditional agreement to be bound by these Terms as amended.  

3              Privacy

3.1          All information about you that we hold is stored and used in accordance with our Privacy Policy, which is available here https://www.tacomedic.co.nz/privacy-policy.

4             Liability

4.1          While Taco Medic has sought to ensure that the information contained on or accessed through the Website and the Apps is correct and current at the time of publication, Taco Medic, to the extent permitted by law, does not accept responsibility for any error, omission or defect in the information.

4.2          Subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, under no circumstances (including but not limited to any act or omission on the part of Taco Medic, its affiliated companies, or their directors, employees, agents and contractors) will Taco Medic, its affiliated companies or their directors, employees, agents or contractors accept any liability for any loss or damage, including for any indirect, incidental, special and/or consequential damages or loss of profits resulting from any use or access, or any inability to use or access the Website or Apps, or arising out of or in connection with any goods or services supplied by Taco Medic.

5              Indemnity

5.1          To the maximum extent permitted by law, you agree to indemnify and keep indemnified Taco Medic and our affiliated companies (those indemnified) against any damage, loss, or expense (including legal costs on a solicitor/client basis) incurred by those indemnified as a direct or indirect result of the violation of these Terms by you, or your access and/or use of the Website or Apps.

6              Ordering

6.1          By placing an order on our Website or via the Ordering App, you accept and agree to be bound by these terms and conditions without limitation or qualification.

6.2          All prices available on the Website and the Ordering App are in New Zealand dollars and include GST.

6.3          Your order will only become an accepted order once payment is made in full by credit or debit card or by e-voucher. We reserve the right to charge credit card fees.

6.4          Once we have accepted an order, you will be advised of the processing time of the order. Processing times are estimates only.

6.5          If you have any allergies, you must notify us at the time you place your order on the Website or via the Ordering App or by calling your local restaurant.

7              Loyalty Programme

7.1          You have the opportunity to earn loyalty points which can be exchanged for certain rewards by registering an account through the Loyalty App.  
 
7.2          The terms of the Taco Medic Mates loyalty programme are as follows:
7.2.1      You may earn 1 reward point for every dollar you spend at a Taco Medic restaurant, either at the restaurant or online including via the Ordering App.
7.2.2      Details of the number of points required to redeem certain rewards will be set out in the Loyalty App and/or on the Website.
7.2.3      Once you have earnt the required number of points to redeem a reward, you may apply those rewards when placing an order either at a Taco Medic restaurant.
7.2.4      Reward points cannot be transferred between accounts.
7.2.5      Reward points cannot be used in conjunction with any other offer, promotion, voucher or discount.
7.2.6      Reward points are collected by scanning your receipt in the Loyalty App or by entering the unique code on the receipt in the Loyalty App.
7.2.7      Points are only calculated on the final transactions after any discounts or other reductions are applied.
7.2.8      Points and rewards will expire 12 months after the date of issue or redemption (as applicable).
7.2.9      Points cannot be earned on delivery fees.

7.3          Taco Medic reserves the right to modify or amend the Taco Medic Mates loyalty programme at any time without notice, including the types of rewards that are available and/or the requirements relating to the number of points required to redeem a reward. 

7.4          Taco Medic will not be liable for any loss or inability to earn points or redeem rewards due to technical difficulty or the system or Loyalty App being offline for any reason.

8              Vouchers             E-Vouchers

8.1          Physical vouchers are available for purchase instore at any Taco Medic restaurant.
8.2          E-vouchers are available for purchase from a third-party service provider through the website: https://app.gift-it.com.au/buy/tacomedic
8.3          The following terms apply to all Taco Medic vouchers, including e-vouchers:
8.3.1      E-vouchers may take up to 24 hours to be activated.
8.3.2      Vouchers are not refundable and cannot be reloaded with credit, returned, redeemed for cash or used towards the purchase of another voucher.
8.3.3      The minimum value you can load on a voucher is $10.00. The maximum value of a single voucher is $500.00.
8.3.4      Vouchers can be used for the purchase of any goods at any Taco Medic restaurant nationwide.
8.3.5      Vouchers will expire on the date which is 12months after the date of purchase. Any remaining balance on expiry will be forfeited and will not be refunded to the voucher holder or the original purchaser or transferred to any other voucher.  
8.3.6      Taco Medic is not responsible for lost or stolen vouchers.  
8.3.7      E-voucher balances can be checked in-store at any Taco Medic restaurant.

9              Intellectual property

9.1          All copyright, trade marks and other intellectual property rights in the Website and the Apps, their content (including without limitation, logos, design, written and graphical content, images, layout and underlying software and source code) (Intellectual Property) is owned by or licensed to Taco Medic or one of its affiliated companies.

9.2          These Terms grant to you a limited royalty-free, personal, revocable, non-transferable, non-sublicensable, licence to use theIntellectual Property only to access and use this Website for the purposes of browsing the Website or the Apps and/or purchasing products or services from us.

9.3          You must not:

9.3.1      copy, reproduce, republish, upload, post, transmit or distribute any part of the Intellectual Property; or
9.3.2      use or deal with the Intellectual Property except as permitted by these Terms.

10             Restrictions on use of the Website

10.1          You must not use or access the Website or the Apps:

10.1.1      for any illegal purpose;
10.1.2      in any manner that could damage, disable, overburden or impair any of Taco Medic’s servers or the networks connected to those servers;
10.1.3      in any way that interferes with any third party’s use and enjoyment of the Website
10.1.4      to make any comments or post any material that is abusive, bullying, or offensive; or
10.1.5       for any purpose other than for your own personal use.

11             General terms and conditions of use

11.1          This Website is provided without any warranty that access to it will be uninterrupted, secure or error-free.

11.2          These Terms are governed by New Zealand law. You agree to submit to the exclusive jurisdiction of the New Zealand courts in relation to any matter to which these Terms apply.

11.3          If we do not enforce any part of these Terms, that is not a waiver of our right to enforce at a later time.

11.4          If any part of these Terms is found to be invalid, unenforceable or illegal, the remaining provisions will continue in full force and effect.

11.5          We reserve the right to refuse (including taking steps to prevent) your access to all or any part of this Website without notice.

13              Competitions

13.1           Entries:

13.1.1       Only open to residents of New Zealand.
13.1.2       Taco Medic International will not accept responsibility for any late submissions, any entries that are not received or any entries or files that are corrupt, damaged, lost or inaccessible.
13.1.3       By participating in the competition, you agree to be bound by the terms and conditions, including all eligibility requirements. You also accept that all decisions made by Taco Medic International are final and binding in all matters relating to the contest.
13.1.4       Taco Medic International reserves the right to cancel the contest at any time, for any reason and without prior notification.
13.1.5       By entering this competition, you agree that you have the consent of any people who are clearly identifiable in your entry.
13.1.6       By entering, each entrant warrants that their entry is original and that their submission does not or will not infringe any third party's intellectual property.
13.1.7       Taco Medic International may collect your personal information (name and contact details) for the purpose of administering and processing the competition only, unless you have verified that your information can be added to the Taco Medic Mates Loyalty Program.
13.1.8       This promotion is in no way sponsored, endorsed or administered by, or associated with, Meta.

13.2          Eligibility

13.2.1       You must be:
13.2.1.1    Residing in New Zealand, in either Auckland or Queenstown

13.2.2       You cannot be:
13.2.2.1    An employee of Taco Medic International, or a prize sponsor.
13.2.2.2    An immediate family member of an employee of Taco Medic International or a prize sponsor.
